Terms & Conditions partner program

§ 1 Provider

The provider of the affiliate program is Trachten24 GmbH, located in 93057 Regensburg, represented by the management.

§ 2 Subject Matter of the Agreement

These terms govern the participation of partners (hereinafter “Partners”) in the provider’s affiliate program. The purpose of participation is to promote and advertise the provider’s products. If a sale in the provider’s online shop is concluded based on a Partner’s recommendation, the Partner receives a commission in accordance with these terms.

§ 3 Registration and Approval

  1. Participation requires an application via the corresponding online form.
  2. The provider reviews each application. Approval may be refused without stating reasons.
  3. After approval, the Partner receives access to their Partner account (overview of clicks, sales and commission status).

§ 4 Commissions and Settlement

  1. The Partner receives a commission of 10% of the net shopping cart value for every completed and fully paid sale that can be clearly attributed to the individual partner link or partner code.
  2. The attribution (tracking) period is 14 days from the first click.
  3. When using coupon codes, a commission credit is granted in any case.
  4. Commissions are paid out quarterly, provided a minimum amount of €50.00 has been reached. If this amount is not reached, the balance will automatically be carried over to the next quarter.
  5. No commissions arise if orders are cancelled, revoked, not paid or are suspected of fraud.

§ 5 Rights and Obligations of the Partner

  1. The Partner independently promotes the products and may only use truthful, legally permissible and brand-compliant content.
  2. Image, video or other marketing material may only be used after prior consultation or approval by the provider.
  3. The Partner acts independently and not as an employee, commercial agent or intermediary with authorization to conclude contracts.
  4. The Partner may not use anti-competitive methods, in particular no spam, brand bidding in search engines or misleading advertising claims.

§ 6 Term of Agreement and Termination

  1. The contract runs for an indefinite period.
  2. Both parties may terminate the contract at any time without notice.
  3. Commissions confirmed at the time of termination will still be paid out properly.

§ 7 Liability

The Partner promotes products at their own responsibility. The provider is only liable for intent and gross negligence.

§ 8 Data Protection

Personal data is processed exclusively for the purpose of assigning sales, settling commissions and fulfilling the contract. The current privacy policy of the provider applies.

§ 9 Amendments

The provider is entitled to amend these terms. Amendments will be communicated to the Partner in good time. If the Partner does not object in writing within 14 days, the amendments are deemed accepted.

§ 10 Final Provisions

German law applies. Place of jurisdiction is the registered office of the provider (Trachten24 GmbH, 93057 Regensburg).
